1. Interpretation and Definitions

The words of which the initial letter is capitalized have meanings defined under the following conditions.

Definitions:

  • App refers to PhoneDown: Focus On mobile application.
  • Company (referred to as either "We", "Us" or "Our") refers to the developer and operator of PhoneDown.
  • Country refers to: China
  • Device means any device that can access the App such as an iPhone, iPad or other mobile device.
  • Service refers to the App and Website.
  • Terms mean these Terms of Service.
  • You means the individual accessing or using the Service.

2. Acknowledgment

These Terms govern your use of our Service. By accessing or using the Service, you agree to these Terms. If you disagree with any part of the Terms, you may not access the Service.

You represent that you are at least 13 years old. If you are between 13 and 18 years old, you represent that your legal guardian has reviewed and agrees to these Terms.

3. Subscription Terms

Some features of the App require a subscription. By subscribing, you agree:

  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period
  • Your account will be charged for renewal within 24-hours prior to the end of the current period
  • You can manage and cancel your subscription in your Apple ID account settings
  • Any unused portion of a free trial period will be forfeited when you purchase a subscription
  • All purchases are final and non-refundable, except as required by law
  • Refunds are processed according to Apple's App Store refund policy

4. App Functionality and Permissions

The App uses iOS system frameworks including FamilyControls, DeviceActivity, and ManagedSettings. You understand and agree that:

  • Certain features require specific system permissions to function
  • The App may request permission to access your device's Identifier for Advertisers (IDFA) through Apple's App Tracking Transparency framework for advertising attribution purposes
  • The App's effectiveness depends on system framework availability and functionality
  • We are not liable for limitations imposed by the iOS system
  • Personal focus data is processed locally on your device; analytics data may be processed by third-party services as described in our Privacy Policy

5. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we handle your data and is incorporated into these Terms. We commit to:

  • Process personal data in accordance with applicable laws
  • Store your personal focus settings and scene data locally on your device
  • Use third-party analytics services (such as Firebase Analytics) to improve our services, with data processed according to their privacy policies
  • Request explicit consent before accessing advertising identifiers (IDFA) for attribution purposes
  • Not share personally identifiable information with third parties without your consent
  • Implement reasonable security measures to protect your data

6. Third-Party Services

The App integrates with third-party services to enhance functionality and user experience. You acknowledge and agree that:

  • We use Firebase Analytics (Google) to collect and analyze app usage data for improving our services
  • Third-party services operate under their own terms of service and privacy policies
  • We are not responsible for the practices or policies of third-party services
  • Your use of these services through our App is subject to their respective terms
  • You may opt out of certain data collection through your device settings

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to:

  • The Service will be uninterrupted or error-free
  • Defects will be corrected
  • The Service will be free of viruses or other harmful components

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes through the App or via email. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of China. Any disputes shall be subject to the exclusive jurisdiction of the courts of China.
